Right to Financial Privacy Act Notice
Under the Right to Financial Privacy Act of 1978 (12 U.S.C. 3401-3421), all affected educational institutions, lenders, subsequent holders, guarantors and the U.S. Department of Education will have access to financial records in your student loan file maintained by the lender in accordance with the administration of the GSLR. In addition, your application for this loan authorizes the educational institution(s), lending institution(s), guarantor(s), subsequent holder(s), U.S. Department of Education, or their agents, and other educational institutions, to release information pertinent to this loan among each other to the extent permitted by law (e.g. Employment, enrollment status, current enrollment, and other aspects of your student loan borrowing history).
Equal Credit Opportunity Act
The federal Equal Credit Opportunity Act (ECOA)(15 U.S.C 1691 et seq) prohibits creditors from discriminating against credit applicants on the basis of race, color, religion, national origin, sex, marital status, or age; or because all or a part of the applicant's income derives from any public assistance program; or because the applicant has, in good faith, exercised any right under the Consumer Credit Protection Act. Information on the Privacy Act and Use of your Social Security Number
Section 7(b) of the Privacy Act of 1974 (5 U.S.C. 552a) requires that when any Federal, State, or local government agency requests an individual to disclose his Social Security Number that individual must also be advised whether that disclosure is mandatory or voluntary, by what statutory or other authority the number is solicited and what uses will be made of it.
Section 7(a)(2) of the Privacy Act provides that an agency may continue to require disclosure of an individual's Social Security Number as a condition for the granting of a right, benefit or privilege provided by law where the agency required this disclosure under statute or regulation prior to January 1, 1975 in order to verify the identity of an individual.
Disclosure of the applicant's Social Security Number (SSN) is required as a condition for participation in The Federal Consolidation Loan Program as Academic Lending Center and the guarantor and the U.S. Department of Education have, for several years, consistently required the disclosure of the SSN on application forms and other necessary adopted pursuant to published regulations (34 CFR, Part 682).
- The authority for collecting the requested information is Section 428(b)(2)(A) of the Higher Education Act of 1965, as amended (20 U.S.C. 1078(b)(2)(A)). Applicants are advised that participation in the Federal Consolidation Student Loan Program is voluntary, but the requested information is necessary for participation in the Federal Consolidation Loan Program.
- The principle purposes of this information are as follows: to verify the identity of the applicant; to determine program eligibility and benefits; to permit servicing of the loan; and in the event it is necessary, to locate missing borrowers and collect on delinquent or defaulted loans.
- The routine uses include the following: the information may be furnished during the life of the loan to holders of this and other loans made to borrower under the Federal Consolidation Loan Program; to educational institutions in which the borrower is enrolled or is accepted for enrollment; to guarantee agencies to contractors which assist the U.S. Department of Education in the administration of the Program; to Federal or State agencies or private parties who may be able to provide information necessary for the collection of the loan, or to assist in the servicing or collection of the loan.
